1. About these Terms and Conditions

These Terms and Conditions (“Terms”) apply to your use of bossbabeduchess.com (the “Website”) and to any services, products or content provided by Boss Babe Duchess, the personal brand of Rayleen Badenhorst, working online and by booked consultation across South Africa, the USA, the UK and Europe (“we”, “us”, “our”).

By using the Website or engaging our services, you agree to these Terms. If you do not agree, please do not use the Website.

2. Our services

We provide creative services including creative direction, content creation, photography and video, video editing, design, branding, social media marketing and concept development, as well as digital products, games and entertainment content.

The scope, deliverables, timelines and fees for any project are agreed in writing (by email, quote or proposal) before work starts. That written agreement forms part of these Terms.

3. Quotes, payment and deposits

Quotes are valid for 14 days unless stated otherwise. We may require a deposit before work begins. Accepted payment methods include cash, PayPal, MoonPay, cryptocurrencies and Wise transfers; payment details are provided on request.

Invoices are payable within the period stated on the invoice. We may pause work on overdue accounts. Prices are in South African Rand (ZAR) unless agreed otherwise.

4. Revisions, changes and cancellations

Each project includes the number of revision rounds stated in the quote. Additional changes or changes in scope may be charged separately.

If you cancel a project, fees for work already completed and any non-refundable costs remain payable. Deposits are non-refundable once work has started, unless the law requires otherwise.

5. Consumer rights

If you are a consumer, nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002 (ECTA), where they apply.

6. Intellectual property

All content on the Website, including text, logos, designs, characters (including Lilith MoonXStar), games, music, images and videos, belongs to Rayleen Badenhorst | Boss Babe Duchess or its licensors, and may not be copied, reproduced or used commercially without written permission.

For client projects, ownership of final deliverables passes to the client once paid in full, unless agreed otherwise. We may show completed work in our portfolio unless you ask us not to in writing.

7. Donations

Donations to support our game development are voluntary gifts. They do not buy ownership, equity, products or any guaranteed reward, and are non-refundable unless the law requires otherwise.

8. Website use

• Do not use the Website for any unlawful purpose.
• Do not try to gain unauthorised access to the Website or its systems.
• Do not copy or scrape content without permission.

9. Third-party links and platforms

The Website links to third-party sites and platforms (such as YouTube, Instagram, X, TikTok and payment providers). We are not responsible for their content, availability or policies.

10. Limitation of liability

To the extent allowed by law, we are not liable for indirect or consequential loss arising from your use of the Website or our services. Our total liability for any project is limited to the fees you paid for that project.

11. Privacy

We handle personal information in line with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA).

12. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be handled by the competent courts of South Africa.

13. Changes to these Terms and Conditions

We may update these Terms from time to time. The latest version will always be on this page, with the date it was last updated.
